Security Forces in Kashmir Charged With Rights Abuses

The authorities in Indian-administered Kashmir have launched more than 400 cases of alleged human rights abuses against security forces personnel. The region’s minister for internal security released the figures in the Jammu and Kashmir legislative assembly.

Kashmiri officials want to revoke the Armed Forces Special Powers Act, which prevents prosecution of security staff. There has been a rebellion against Indian rule in divided Kashmir, which is also claimed by Pakistan.

Thousands of people have been killed in the region since the rebellion began in 1989, though violence has dropped off recently. India’s defence ministry has resisted moves to revoke the Armed Forces Special Powers Act (AFSPA).

According to the state government of Indian-administered Kashmir, 444 soldiers, police and security officials have been charged in the past three years.

Nearly 300 cases have been seen in local courts, the government said on Monday in a written response to the Jammu and Kashmir assembly. Human rights activists say the Indian authorities are forcing the Kashmir government to move slowly on these cases.

Kashmiri officials have been pleading with Delhi to scrap the AFSPA so they can proceed with prosecuting security officials against whom cases are pending.

But army officials say it is needed to prevent militant groups based in Pakistan from focusing their resources on Kashmir.

China Seeks Military Bases in Pakistan

While Pakistan wants China to build a naval base at its southwestern seaport of Gwadar in Balochistan province, Beijing is more interested in setting up military bases either in the Federally Administered Tribal Areas (FATA) of Pakistan or in the Federally Administered Northern Areas (FANA) that border Xinjiang province.

The Chinese desire is meant to contain growing terrorist activities of Chinese rebels belonging to the al-Qaeda-linked East Turkestan Islamic Movement (ETIM) that is also described as the Turkistani Islamic Party (TIP).

The Chinese Muslim rebels want the creation of an independent Islamic state and are allegedly being trained in the tribal areas of Pakistan. According to well-placed diplomatic circles in Islamabad, Beijing’s wish for a military presence in Pakistan was discussed at length by the political and military leadership of both countries in recent months as China (which views the Uyghur separatist sentiment as a dire threat) has become ever-more concerned about Pakistan’s tribal areas as a haven for radicals.

Beijing believes that similar to the United States military presence in Pakistan, a Chinese attendance would enable its military to effectively counter the Muslim separatists who have been operating from the tribal areas of Pakistan for almost a decade, carrying out cross-border terrorist activities in trouble-stricken Xinjiang province.

There have been three high-profile visits from Pakistan to China in recent months; the first by Foreign Minister Hina Rabbani Khar; the second by President Asif Ali Zardari and the third by the director general of the Inter-Services Intelligence, Lieutenant General Ahmed Shuja Pasha.

The Pakistani visits were reciprocated by the September 28 visits to Islamabad by Chinese Vice Premier Meng Jianzhu and Public Security Minister Meng Jianzhu. This was prompted by two bomb blasts in Kashgar city of Xinjiang province on July 30 and 31 in which 18 people were killed.

The explosions provoked senior government officials in Xinjiang to publicly claim for the first time in recent years that the attackers had been trained in explosives in ETIM/TIP camps run by Chinese separatists in the Waziristan tribal regions of Pakistan.

The Chinese allegation was described by many in the diplomatic circles of Islamabad as a clear sign of the growing impatience of Beijing with Islamabad’s failure to control radical groups operating within its borders.

The Chinese charge was made on the basis of a confession by a Uyghur militant arrested by the Chinese authorities. Pakistan swiftly extended all possible cooperation to Beijing against the ETIM/TIP network. “Terrorists, extremists and separatists in Xinjiang province constitute an evil force,” said an August 1 statement issued by the Pakistani Foreign Ministry after Chinese President Hu Jintao rang Zardari to express his grave concern over the growing activities of “terrorists” belonging to the Pakistan-based ETIM/TIP network.

In a subsequent video released on September 7, ETIM/TIP corroborated earlier Chinese claims that it was involved in attacks in Xinjiang in July.

The ETIM/TIP, run by natives of Xinjiang province, a Muslim-dominated region three times the size of France, is fighting against the settlement of China’s majority Han ethnic group in the western province, describing its struggle as a freedom movement.

The ETIM/TIP maintains that the Chinese are a colonial force in Xinjiang province – which it refers to as Turkistan – and emphasizes Islam over ethnicity. Though the ETIM/TIP network on the Pakistan-Afghanistan border has been much weakened in recent years in the wake of the killing of many of its top leaders in US drone attacks, hardcore Uyghur militants are still shuttling between China and Pakistan, mainly because Xinjiang province shares a border with Pakistan.

The ETIM/TIP presence in Pakistan was first confirmed when one of its founding leaders, Hasan Mahsum alias Abu Muhammad al-Turkistan, was killed by Pakistani security forces in South Waziristan in October 2003.

The next one to be killed by the Americans in a drone attack was Memetiming Memeti alias Abdul Haq al-Turkistani, the ETIM/TIP chief, who was targeted in North Waziristan on February 15, 2010. Abdul Haq was succeeded by Abdul Shakoor Turkistani, a Chinese Uyghur, who is well known for his friendly terms with major Taliban groups in Waziristan.

He has taken control of overall command of Chinese and Uzbek militants in North Waziristan, due to his past association with the late Abdul Haq and late Tahir Yuldashev of the Islamic Movement of Uzbekistan.

Beijing believes that the Chinese rebels operating from the Pakistani tribal areas are well-connected to al-Qaeda, which not only trains them but also provides funding.

Thus, Pakistan and China, which have cooperated for a long time in the field of counter-terrorism, have intensified their efforts to nip the terrorism in the bud, especially after the Kashgar blasts.

In fact, it was in the aftermath of the May 2 US raid which killed al-Qaeda chief Osama bin Laden in his Abbottabad hideout that Islamabad started playing its China card aggressively, perhaps to caution Washington against pushing it too hard. Shortly after the Abbottabad raid, Pakistani Prime Minister Yousaf Raza Gillani traveled to Beijing.

Accompanying Defense Minister Ahmed Mukhtar had stated on May 21 that whatever requests for assistance the Pakistani side made, the Chinese government was more than happy to oblige, including agreeing to take over operations of the strategically positioned but underused port of Gwadar on the Arabian Sea on expiry of a contract with a Singaporean government company.

He disclosed that Pakistan had asked China to begin building a naval base at Gwadar, where Beijing funded and built the port. “We would be grateful to the Chinese government if a naval base is constructed at the site of Gwadar for Pakistan,” he said in a statement. Mukhtar later told a British newspaper in an interview: “We have asked our Chinese brothers to please build a naval base at Gwadar port.”

Knowledgeable Defense Ministry sources in Islamabad say that by having a Chinese naval base in the Gwadar area, Pakistan intends to counter-balance Indian naval forces.

However, diplomatic circles in Islamabad say Beijing, which has no military bases outside its territory and has often been vocal in criticizing American moves for operating such bases, first wants to establish military bases in Pakistan, which could be followed by the setting up of the naval base.

Therefore, Chinese Defense Minister Liang Guanglie promptly dismissed (on June 6) suggestions that Beijing was carving out a permanent naval presence in India’s neighborhood.

Answering questions at the 10th Asia Security Summit, organized by the London-based International Institute for Strategic Studies, Liang disclaimed moves to build naval bases at Gwadar and at a Sri Lankan port. Emphasizing his credentials as a member of the Chinese State Council and Central Military Commission, he said:
We will have a very serious and careful study of an issue of such importance to the government and the military like the reported move for establishing naval bases in Pakistan and Sri Lanka. Indeed, we will have exact plans and set up a panel to discuss it if the move were for real. However, I haven’t heard of it.

Asked by Manish Tewari, the Indian Congress party’s spokesman, to spell out China’s core interests in South Asia and the Indian Ocean area, Liang said:
The core interests include anything related to sovereignty, stability and form of government. China is now pursuing socialism. If there is any attempt to reject this path, it will touch upon China’s core interests. Or, if there is any attempt to encourage any part of China to secede, that also touches upon China’s core interests related to our land, sea or air. Then, anything that is related to China’s national economic and social development also touches upon China’s core interests.
The Chinese desire to have military bases in Pakistan is not a new one and has been discussed in the past.

An article published on the official website of the Chinese central government (www.gov.cn) on January 28, 2010, signaled that Beijing wanted to go the US way and set up military bases in overseas locations that would possibly include Pakistan. The obvious purpose would be to exert pressure on India as well as counter American influence in Pakistan and Afghanistan. The article stated:
Setting up overseas military bases is not an idea we have to shun; on the contrary, it is our right. It is baseless to say that we will not set up any military bases in future because we have never sent troops abroad. As for the military aspect, we should be able to conduct a retaliatory attack within the country or at the neighboring area of our potential enemies. We should also be able to put pressure on the overseas interests of potential enemies. With further development, China will be in great demand of military protection.
Analysts say although it might not be politically feasible for the Pakistani government to openly allow China to set up military bases on its soil, Islamabad might allow Beijing the use of its military facilities without any public announcement as a first step.

The Chinese demand to set up military bases in Pakistan has gained momentum at a time when the Indian military leadership is already raising a hue and cry over the alleged presence of People’s Liberation Army (PLA) troops in the Pakistan-administered part of Kashmir as well as in the FANA, which was earlier called Gilgit and Baltistan.

In August 2009, the Pakistan government passed the Gilgit-Baltistan Empowerment and Self-Governance Order to grant self-rule to the people of the area and create an elected legislative assembly. Gilgit-Baltistan thus gained de facto province-like status without doing so constitutionally.

Gilgit Baltistan province borders Pakistan’s Khyber Pukhtunkhwa province to the west, Afghanistan’s Wakhan Corridor to the north, China to the east and northeast, Pakistan-administered Kashmir to the southwest, and Jammu Kashmir to the southeast.

Although the supposed Chinese military presence in Pakistan’s northern areas of Gilgit Baltistan has been a matter of intense speculation in India, it was on October 5 that Indian army chief General V K Singh went public for the first time with the Indian establishment’s assessment of the kind of Chinese presence in the northern areas of Pakistan. “Around 4,000 Chinese including troops of the People’s Liberation Army are present in Pakistan-occupied Kashmir,” Singh told journalists in New Delhi.

However, senior Foreign Office officials of Xinjiang told this writer during a briefing in Urumqi, the capital of the province, that the Indian army chief’s claim was fallacious and must be based on some misunderstanding.

Despite the fact that diplomatic ties between China and India have improved in recent years, they are still at odds over territorial claims from both countries dating back to the India-China border war in 1962.

While India and Pakistan control Pakistan-administered Kashmir (Azad) and Jammu Kashmir states respectively, China claims part of northeastern Kashmir that it says is a part of Tibet. Therefore, Beijing is highly critical of India’s support for the Tibetan spiritual leader, the Dalai Lama, who fled Tibet in 1959 and set up a government in exile in the northern Indian hill town of Dharmsala.

The Indian army chief was not the first senior military official to have talked about the alleged Chinese presence in the northern areas of Pakistan.

In April this year, Northern Army Commander Lieutenant General K T Parnaik, while addressing a seminar in Jammu and Kashmir, said that the Chinese footprint in Pakistan-administered Kashmir was increasing steadily and its troops were actually present along the line of control (LoC) that divides the disputed Kashmir area.

“The Chinese presence in Gilgit-Baltistan and the northern areas of Pakistan is increasing steadily. There are many who are concerned about the fact that if there was to be hostility between India and Pakistan, what would be the complicity of the Chinese. Not only are they in the neighborhood, but the fact is that they are actually present and stationed along the LoC,” Parnaik said.

Zhang Xiaodi, the director general of the foreign affairs office in Urumqi, told this writer in a meeting on October 10 that there is no truth in the allegations leveled by Indian military officials. “There are only Chinese construction teams working in the northern areas of Pakistan on certain development projects being carried out by Pakistan and China jointly. The presence of People’s Liberation Army troops there is out of question.”

At the same time, there are those in the Pakistani Embassy in Beijing who view the Indian army chief’s allegation against the backdrop of the Pakistan army’s recent decision to include for the first time Chinese troops in military exercises along the border with the Indian states of Punjab and Rajasthan; the 101 Engineering Regiment of the PLA took part in exercises with their Pakistani counterparts in August this year.

Analysts say China’s deepening strategic penetration of Pakistan and the joint plans to set up not only new oil pipelines and railroads but also naval and military bases, are enough to set alarm bells ringing in New Delhi and Washington. The repercussions are particularly stark for India because both Beijing and Islamabad refuse to accept the territorial status quo and lay claim to large tracts of Indian land that could come under Chinese sway once Beijing is allowed to establish military bases in Pakistan.

The fact that Gilgit and Baltistan is located in the Pakistani-administered part of Kashmir presents India with a two-front theater in the event of a war with either country. By deploying troops near the LoC and playing the Kashmir card against New Delhi, Beijing is clearly signaling that Kashmir is where the Sino-Pakistan nexus can squeeze India.

China Ramps Up Pressure Over Kashmir

BANGALORE – A recent report in the Chinese media describing the Sino-Indian border as being 2,000 kilometers long, roughly 1,500 km shorter than that defined by India, has evoked an alarmed response among sections of the Indian strategic community.

The “missing 1,500 km” from the definition of the Sino-Indian border is seen to be a clear pointer to Beijing’s hardening position, not only on its long-standing boundary dispute with India but also on Jammu and Kashmir (J&K). While India holds about 45% of J&K territory and Pakistan controls 35%, China occupies about 20% (including Aksai Chin and the Shaksgam Valley, ceded by Pakistan to China in 1963).

A Beijing-datelined Xinhua news agency report of an official briefing by China’s Assistant Foreign Minister Hu Zhengyue on the eve of Prime Minister Wen Jiabao’s recent visit to India triggered the flap. “China and India share a 2,000-km-long border that has never been formally demarcated,” the report said. India describes the border as being 3,488 km.

The different positions were made even more explicit by the Global Times, an English-language newspaper published by the People’s Daily, the official mouthpiece of the ruling Chinese Communist Party. In an interview with Global Times, India’s ambassador to China, Subrahmanyam Jaishankar, spoke of the “long common border of 3,488 kilometers” between the two countries. But a comment by the editors of Global Times in parentheses said: “There is no settled length of the common border. The Chinese government often refers to the border length as being ‘about 2,000 kilometers’.”

Reports in state-owned media have been describing the border as being 2,000 km for at least a year now.

The roughly 1,500 km-long shortfall in the Chinese perception is believed to refer to the Sino-Indian boundary in J&K. “China apparently no longer treats the line of nearly 1,600 km separating Jammu and Kashmir on the one hand and Xinjiang and Tibet on the other as a border with India,” strategic affairs expert C Raja Mohan wrote in the Indian Express. That is, it does not recognize Kashmir to be part of India.

Beijing is questioning India’s locus standi to discuss J&K’s border with China, observes B Raman, a retired director in India’s external intelligence agency, the Research and Analysis Wing (RAW). In essence, it is seeking to exclude discussion of the western sector of the disputed Sino-Indian boundary with India. The western sector includes the large chunk of Indian territory, Aksai Chin, in the Ladakh region of Jammu and Kashmir that China occupied in 1962.

Besides, China “wants to change the format of the border talks in order to keep it confined bilaterally to the eastern and middle sectors and expand it to a trilateral issue involving India, China and Pakistan in the western sector,” Raman wrote recently.

China has become increasingly assertive in its questioning of India’s sovereignty over J&K. Since 2008, it has been issuing visas on a separate sheet of paper to residents of Jammu and Kashmir rather than stamping the visa in their passports, as is the norm with other Indian citizens. In August last year, China also denied a visa to Lieutenant General B S Jaswal – commander of the Indian army’s Northern Command, which includes Kashmir – for an official visit to China, on the grounds that he “controlled” a “disputed area”.

Besides, over the past year, Beijing has been reaching out to the Hurriyat Conference, an umbrella organization of Kashmiri separatist outfits. In March 2010, for instance, Chinese Foreign Affairs director Ying Gang met with Hurriyat leader Mirwaiz Umar Farooq in Geneva on the sidelines of the 13th session of the UN Human Rights Council. Besides questioning India’s sovereignty over Kashmir, China has been endorsing Islamabad’s control over the part of Kashmir it has administered since 1947.

It was with India that the Maharajah of Jammu and Kashmir, Hari Singh, signed an Instrument of Accession in October 1947. However, only 45% of the territory of the former princely state is in India’s hands today, roughly 35% remaining under Pakistani administration and another 20% under Chinese control. The territory under Chinese occupation includes Aksai Chin and the Shaksgam Valley that Pakistan gifted to China in 1963.

In the Northern Areas of Pakistan-administered Kashmir, China is involved in the construction of several infrastructure projects, including roads, hydroelectric power projects, dams, expressways, bridges and telecommunication facilities. During Wen’s recent visit to Pakistan, the two countries signed a US$275 million agreement for repair and expansion of the Karakoram Highway. Earlier in September, Beijing underlined its support to Islamabad’s territorial claims over parts of Pakistan-administered Kashmir when it described the Northern Areas as “a northern part of Pakistan”.

The India-Pakistan dispute over Kashmir predates the People’s Republic of China (PRC). India and Pakistan had already fought their first war over Kashmir when the PRC came into being. Initially, China took its cues from the Soviet Union on the issue. It described the conflict as a Western creation and maintained that the US and Britain were hoping to make Kashmir a Western base.
China took a “neutral position” in the 1950s. It opposed foreign arbitration on the Kashmir issue, which pleased India. At the same time, it did not endorse Delhi’s claims over Kashmir. Fraying Sino-Soviet relations and Moscow’s overt support to Jammu and Kashmir as “an inalienable part of the Republic of India”, as well as concerns that its backing of India would push Pakistan into a closer embrace of the US, seem to have prompted it to adopt a more “neutral position” between India and Pakistan on Kashmir.

With Sino-Indian relations deteriorating from 1959 onwards, China began tilting towards Pakistan. It signed a border agreement with Pakistan. Since this dealt with areas that constituted Pakistan-administered Kashmir, the agreement amounted to a de facto Chinese recognition of Pakistan’s control over this area. Although it subsequently denied such recognition, describing this as “provisional” and “pending settlement of the Kashmir dispute”, a joint communique issued at the end of prime minister Zhou Enlai’s visit to Pakistan in February 1964 was a strong endorsement of the Pakistani position. It urged a solution of the dispute “in accordance with the wishes of the people of Kashmir”. India is opposed to a plebiscite in Kashmir.

By the mid/late 1970s, China began advocating a status quo on Kashmir. Support for the Kashmiris’ right to self-determination was toned down. In 1976, in his speech before the UN General Assembly, Chinese foreign minister Chia Kuan-Hua omitted naming Kashmir in a list of territories where the right to self-determination had not been exercised. It is believed that China’s own troubles with separatism and improving ties with India prompted its shrinking support on self-determination.

With Sino-Indian rapprochement gathering momentum in the 1990s, China began describing Kashmir as a bilateral matter to be resolved by India and Pakistan through peaceful means. On his visit to India in 1996, president Ziang Zemin called on India and Pakistan to set aside contentious issues and build a cooperative relationship. During the brief Kargil conflict in 1999, China called on India and Pakistan to respect the Line of Control that separates Pakistani- and Indian-administered Kashmir. These were seen as signs of Beijing taking a neutral position on Kashmir again.

China has never accepted India’s sovereignty over Jammu and Kashmir, even over the part that is under its control. After all, if it did it would mean giving up the roughly 43,180 square kilometers of territory that is currently under its control. However, it had avoided provoking India on the matter publicly. This has changed in recent years, with Beijing being “deliberately provocative” on Kashmir.

India is not letting the repeated provocations go unchallenged. After all, the territorial integrity of the country is a core concern of the Indian state. A couple of months ago, in his talks with Chinese Foreign Minister Yang Jiechi, India’s External Affairs Minister S M Krishna did some tough talking. According to officials quoted by the Hindu, for the first time India drew a parallel between “the territorial red lines” of the two countries.

Krishna reportedly told Yang that just as India had been sensitive to its concerns over Tibet and Taiwan, Beijing too should be mindful of Indian sensitivities on Jammu and Kashmir. The message that India is sending is that if China questions India’s sovereignty over Kashmir, India will question Beijing’s sovereignty over Tibet and Taiwan.

Delhi has indicated that Krishna’s warning was to be taken seriously. The joint communique issued at the end of Wen’s visit to India made no reference to India’s commitment to a “one china policy”. This is the first time since 1988 that a summit-level joint communique has made no mention of the policy. Instead, both sides agreed to show “mutual respect and sensitivity for each other’s concerns and aspirations”.

India Hints at Pakistan Role in Kashmir Unrest

India’s interior minister hinted on Friday that Pakistan could be behind weeks of violent anti-India protests in the disputed Kashmir region, a move that could hurt the nuclear-armed rivals’ attempts to improve ties.

This is the first time New Delhi has linked Pakistan to the violence in Kashmir that has killed nearly 50 people since June. Earlier India had said Pakistan-based militants were inciting trouble in Kashmir, a region divided between India and Pakistan and which both claim in full.

“Pakistan appears to have altered its strategy in influencing events in Jammu and Kashmir,” Palaniappan Chidambaram told the Indian parliament during a debate on the protests, among the biggest since a separatist revolt against Indian rule broke out in 1989.

“It is possible that they believe that relying upon civilian unrest will pay them better dividends. But I am confident if we are able to win the hearts and minds of the people … those designs can be foiled.”

There were fresh pro-independence protests in several places in Kashmir on Friday. At least two people were wounded when police opened fire on thousands of protesters in Sopore town in north Kashmir.

The minister’s comments could be seen by Islamabad as a provocation, damaging prospects for improving ties that plummeted after the 2008 Mumbai attacks that killed 166 people and derailed a sluggish four-year-old peace process with Pakistan.

So far, the latest violence in Kashmir has appeared to have little impact on relations.

The two sides last held peace talks in July and those ended in acrimony over the attacks, even though the dialogue itself is seen as a tentative step towards improving ties.

Divided Kashmir remains at the heart of the dispute between India and Pakistan, with both sides claiming the Himalayan region in full. They have fought two of their three wars over it.

India accuses Pakistan of fuelling unrest in Kashmir, but Islamabad says it only lends moral support to what it calls Kashmir’s independence movement which has killed tens of thousands of people.

In June, India blamed Pakistan-based Lashkar-e-Taiba (LeT) militants for the Mumbai attacks, but Kashmiri separatists say protests by crowds of mainly Muslim youths are generally spontaneous.

LeT was founded in 1990 to fight Indian rule in Kashmir and is based in Pakistan’s Punjab province.

Militant violence has fallen dramatically in recent years but popular protests have continued. In 2008, the region witnessed the biggest protests against Indian rule in two decades.

Kashmiri separatists want to carve out an independent homeland or merge with predominantly Muslim Pakistan.

Krishna Arrives in Pakistan, Calls Visit ‘a New Beginning’

Indian external affairs minister S M Krishna, who arrived in Islamabad on Wednesday, said that he is on a mission to restore trust and increase confidence between the two countries.

“We hope to discuss all issues of mutual interest and concern that can contribute to restoring trust and building confidence in our bilateral relationship,” Krishna told journalists as he arrived here.

During his three-day visit, Krishna will hold talks with his Pakistani counterpart Shah Mahmood Qureshi on Thursday and will also meet President Asif Ali Zardari and PM Yusuf Raza Gillani. S M Krishna looks forward seeking progress on the issue of terrorism being raised by the Indian home minister P Chidambaram with his Pakistani counterpart Rehman Malik last month in Islamabad.

“I also look forward to receiving feedback on the issues raised by our home minister (P Chidambaram) during his visit to Pakistan last month on our core concern of terrorism, particularly in the light of the discussions our home minister had in Pakistan in the context of interrogation of David Headley regarding the Mumbai terrorist attack,” he said.

Krishna described his visit as important as it marks a new beginning of journey to build a prosperous, friendly and cooperative relationship between the two countries.

India is committed to resolving all issues with Pakistan through peaceful dialogue based on mutual trust and confidence, Krishna said.

“I brought a message of peace and friendship from the people of India and we hope to undertake this voyage of peace, however long and arduous, jointly with the government and people of Pakistan,” he said.
Pakistan’s foreign minister Shah Mehmood Qureshi has said that he will raise with Krishna the issue of alleged human rights in Jammu and Kashmir.

“We are approaching the meeting with a positive mindset,” Qureshi said.
